Terms and Conditions – Online purchase of licence to view and/or listen to recorded materials (www.universalmedicine.com.au)

These terms and conditions of use (“Terms”) relate to any online purchase (“Purchase”) of rights under licence pursuant to these Terms pertaining to video or audio material (“Material”) on or via the www.universalmedicine.com.au website (“Website”). As a condition of my Purchase of the Material I have selected in my purchase order in the cart on the Website (“Purchase Order”), I hereby acknowledge my understanding of and agreement with the following Terms:

  1. No medical claims:
    1. I acknowledge and agree that:
      1. the Material in this video/audio is based on the principles of the Ageless Wisdom which offers an energetic understanding of life and any references to science are references to energetic science as presented by the Ageless Wisdom and not evidence-based science;
      2. the principles presented in this video/audio are philosophical and religious in nature and are not verified by evidence-based science;
      3. Serge Benhayon, Natalie Benhayon and Universal Medicine’s presentations and teachings do not diagnose, treat, prevent or offer a cure for any disease or illness, and are complementary to and are not an alternative to and do not replace conventional medicine;
      4. if I have any questions or concerns about a medical condition, I will consult a registered medical practitioner.
  2. Licence:
    1. Universal Medicine grants me a non-exclusive, non-transferable licence (“Licence”) to view and listen to video and/or audio material (“Material”) as specified on the Purchase Order, in accordance with these Terms.
  3. Copyright
    1. All copyright and other intellectual property rights relating to the Material (including all moral rights) are retained by Universal Medicine at all times.
  4. What I may and may not do
    1. Subject to these Terms, I may download the Material, save it to a personal device and view and/or listen to it.
    2. I may not, in whole or part, sub-licence, sell, publish, distribute, retransmit or otherwise provide access to the Material.
    3. I will not reproduce, republish, rearrange, adapt or modify the Material or create any derivative work based on or containing the Material in any manner or using any platform or medium.
  5. Who may use Material
    1. The right to view or listen to Material pursuant to the Licence is personal to me, and no Material, in whole or part, may be shared with any other person(s) whatsoever.
  6. No use under 18
    1. I am 18 years of age or over.
    2. Without limiting the generality of clause 4 above, the Material is for the viewing/listening and use of person/s 18 years of age and over only and is not, in whole or part, at any time now or in the future, to be viewed by, listened to or shared with any person/s under 18 years of age.
  7. No Warranty
    1. Universal Medicine does not warrant that the Material or the Website will be uninterrupted or error free. The entire risk as to quality and use of the Material is solely with me as licensee. Further, Universal Medicine grants no rights and makes no warranties with regard to the use of any information that may be contained in the Material.
  8. Limitation of liability
    1. To the full extent permitted by law, Universal Medicine disclaims all liability for any Loss incurred by me or any other party as a direct or indirect result of my access to the Material and, without limiting the foregoing, neither Universal Medicine nor any of its officers, employees, managers, directors, shareholders, representatives, contractors, agents or suppliers shall be liable to me or any other person or entity, in contract, tort or otherwise, for any general, punitive, special, indirect, consequential or incidental damages, or lost profits or any other Loss arising out of my use of the Material, unless specifically provided for in these Terms or required by law.
    2. Except as required by law, in no event will Universal Medicine’s total aggregate liability to me or any third party claiming through me or otherwise, arising out of or in connection with my use of or inability to use the Material (whether in contract, tort or otherwise) exceed the monetary amount actually received by Universal Medicine from me for the Licence pursuant to the Purchase.
  9. Right to remove
    1. Universal Medicine may remove Material from its website at any time, for any reason it sees fit, without any right of recourse by me. 
  10. Breach and Termination
    1. I agree and understand that if I, by any act or omission, directly or indirectly cause any breach of these Terms:
      1. The Licence shall be cancelled with immediate effect, without need for notification to me, and my rights to view and/or listen to the Material shall thereby be immediately revoked, and I must immediately destroy all copies of the Material I have stored on any device, or on any medium, and empty the trash;
      2. Universal Medicine may, at its sole discretion and with immediate effect, cancel all subscriptions, or any number of them, that I have on the Website;
      3. No refund shall be payable to me for any such cancellation or revocation pursuant to one or both of paragraphs i) and ii); and
      4. Universal Medicine and its representatives shall, except to the extent required by law, bear no liability for any Loss whatsoever, whether pecuniary or otherwise, and whether direct or indirect, suffered or incurred by me or any other person as a result of any such cancellation or revocation.
  1. In these Terms:
    1. “Loss” means loss, costs, expenses, fees, penalties or liability.
    2. The singular includes the plural and vice versa, a gender includes other genders, headings are for reference only and do not affect interpretation, and different grammatical forms of defined expressions have corresponding meanings;
    3. The failure to exercise or delay in exercise of any right by Universal Medicine shall not be a waiver of prior or subsequent rights;
    4. These Terms constitute the entire agreement between Universal Medicine and me, and supersede any prior discussions, negotiations, agreements or otherwise between Universal Medicine and me;
    5. If any part of these Terms is found by a court to be invalid or unenforceable (“Invalid Part”), the Invalid Part shall be severed from these Terms to the extent of the prohibition of unenforceability (“Severance”) without invalidating the remaining provisions of these Terms, which shall not be affected or impaired by the Severance; and
    6. These terms are governed by the laws of New South Wales, Australia.
